Many property owners use “permit violation” and “zoning violation” interchangeably, but they are legally distinct — and the distinction matters because the resolution paths are different.
A building permit violation means work was done without the required permits or in deviation from approved plans. The issue is how the work was done. Resolution typically involves obtaining after-the-fact permits, passing inspections, and making any necessary corrections. Building permit violations are generally resolvable through the permitting process.
A zoning violation means the property is being used or built upon in a way that violates local land-use rules: setback requirements, height limits, lot coverage maximums, use restrictions, or density rules. The issue is what was built or where it was built. Zoning violations are harder to resolve because they may require a variance (a government-granted exception), which is a discretionary decision by a zoning board.
Unpermitted construction frequently violates both building codes and zoning rules. An unpermitted addition built too close to the property line, for example, is both a permit violation and a setback violation. This makes resolution more complex because you need to satisfy both the building department and the planning/zoning department.
If your violation is purely a building permit issue, the path to resolution is usually clearer. If it also involves zoning, you may need a variance — which is not guaranteed and can involve public hearings and neighbor objections.
