If you have an unpermitted ADU, garage conversion, or granny flat on your property, California’s recent ADU legislation may have made it significantly easier to legalize. The state has been aggressively streamlining ADU permitting since 2017, and many previously impossible legalizations are now practical.
California has passed a series of ADU reform laws that reduce setback requirements, eliminate parking mandates in many cases, limit local agencies’ ability to reject ADUs, create amnesty programs in some jurisdictions, and streamline the permitting process for converting existing structures.
Contact your local building department and ask specifically about ADU legalization programs. Many jurisdictions now have dedicated ADU desks or liaisons. Submit your application with plans showing the existing structure. Be prepared for inspections and possible corrections, particularly for fire safety, egress, and utility connections.
Not every unpermitted ADU can be legalized. Setback violations may be grandfathered in some jurisdictions but not others. Height violations are harder to resolve. And if the structure has fundamental safety issues (inadequate foundation, no proper utilities), the cost of corrections may exceed the value of the unit.
