Few situations are more frustrating than having construction work fail a city inspection — and then the contractor refuses to come back and fix the problems. You're left with an open permit, a code violation, and work that may be unsafe. California law gives you several options.

The Contractor's Obligation

A contractor who pulls a permit has a legal obligation to complete the work to code and obtain final inspection approval. Abandoning a project with an open permit and failed inspection is a violation of the contractor's duties under both the construction contract and California licensing law.

Your Legal Options

Demand the contractor return: Send a written demand requiring the contractor to return and correct the deficiencies within a specific timeframe.

Hire another contractor: If the original contractor refuses to return, you can hire a licensed contractor to complete the corrections. Document all costs — these become part of your damages claim.

File a CSLB complaint: The Contractors State License Board can discipline a contractor who abandons a permitted project.

File a bond claim: Licensed contractors carry a $25,000 surety bond. You can file a claim against this bond to recover your damages.

Sue for damages: Depending on the amount at issue, you can pursue the contractor in small claims court (up to $12,500) or civil court for larger claims.
